Fortunately, even though a final settlement has already been approved and finalized by the court, any remaining or unresolved issues can be amended. Post-Divorce Modifications
After your divorce is finalized, you and your ex-spouse will experience life changes. In the event of substantial changes, divorced couples will want to ask the court to modify certain elements of their divorce settlement. The most common changes are spousal support, child support and timesharing. The court wants us only to petition for “substantial changes,” which might would include a higher paying job, a job layoff, retirement, cohabitating, remarriage, moving out of county/state, and so forth.

Time Sharing
Florida law stipulates that ‘time sharing’ refers to the legal guardian status, residency, and caretaking responsibilities of a child after divorce, legal separation, or paternity degree. One parent is generally awarded physical custody of a child, while the other parent is awarded visitation rights.
Child Support
Florida law stipulates both parents are responsible for child support. That said, one parent usually is deemed the PAYEE parent who will be required to pay ‘child support’ to the other parent. The state of Florida, like most states, has a formula that the court uses to determine potential monthly child support payments. As your lawyer, I can make a case to the court to adjust those payments outside of the formula given special circumstances.
Child Custody
In Florida, “the best interests of the child” is paramount in determining child custody. In fact, Florida has abolished the idea of ‘primary parent’ vs. ‘secondary parent.’ Physical custody’ is where the child resides. There is ‘sole physical custody,’ where the child lives with one parent, and the other parent can have child visitation rights. Then there is ‘joint physical custody,’ where the child lives with both parents on an stipulated rotating basis. The time allotments are not always 50:50.
